BigToolDeals Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your use of the BigToolDeals website and related services ("BTD", "we", "us", or "our"). By using BTD, you agree to these Terms. If you do not agree, do not use the service.

2. What BTD Does

BTD is a tool-deal discovery service. We analyse product and pricing information and identify professional-grade tools that may represent worthwhile deals based on the information and methodology available to us.

BTD does not sell the products displayed on the site, does not operate the retailer websites it links to, and does not control retailer pricing, inventory, availability, shipping, taxes, checkout, seller identity, promotions or retailer terms.

3. Deal Information

BTD's deal information may include prices, historical pricing, discounts, product descriptions, product images, availability information and other product-related information, drawn from external sources and automated systems.

Information may change after it has been collected or displayed. In particular:

• retailer prices can change;
• products can become unavailable;
• seller or fulfilment information can change;
• retailer promotions can expire;
• shipping or tax amounts can change; and
• external data may contain errors or delays.

BTD aims to provide useful and accurate information but does not guarantee that every item of information will always be current or error-free.

4. BTD's 90-Day Historical Methodology

BTD's deal system uses historical pricing information, including 90-day pricing history, as an important reference for identifying potential deals. A BTD discount or ranking represents BTD's calculation based on the data and methodology available to BTD. It is not a guarantee that:

• the product is currently at its lowest historical price;
• the retailer will continue offering the displayed price;
• the displayed price is available to every customer;
• the product is the cheapest available from every retailer; or
• purchasing the product will result in a particular saving.

5. Prices and Availability

Prices and availability shown by BTD are informational. The price and availability shown by the retailer at the time of purchase control the transaction. Confirm the current price, availability, seller, shipping costs, taxes and other applicable terms on the retailer's website before purchasing.

BTD does not knowingly display misleading prices or discounts, and does not treat this section as licence to do so. Where BTD identifies a deal using historical pricing, the historical comparison is not itself a promise that the retailer will honour a particular price.

6. Retailers and Third-Party Websites

BTD links to third-party retailers and websites. Once you leave BTD, the transaction is governed by the third party's own terms and policies. BTD is not a party to your purchase contract with the retailer. Disputes concerning a purchase — delivery, returns, refunds, warranties, product quality, seller conduct or payment — should normally be directed to the retailer or seller concerned.

Nothing in these Terms limits rights you may have against a retailer under applicable consumer law.

7. Affiliate Relationships

BTD may participate in affiliate programs, including the Amazon Associates Program, and may receive a commission when users follow qualifying links and make qualifying purchases. Affiliate relationships do not change the price a retailer charges you unless the retailer separately states otherwise. Our Affiliate Disclosure provides further information.

8. Accounts

Some BTD functionality requires an account. BTD uses passwordless authentication and sends a verification code to the email address associated with your account. You are responsible for providing an email address you control, keeping access to that email account secure, and not allowing others to use your account improperly. You must not impersonate another person or create an account using an email address you do not control.

9. Alerts

BTD may allow you to create alerts based on criteria you choose. Alerts are provided as a convenience. BTD does not guarantee that an alert will identify every qualifying deal, or that an identified deal will remain available when you receive or act on the notification. Alert information may be changed, paused or deleted. Alert emails include an unsubscribe mechanism.

10. Acceptable Use

You must not:

• use BTD for unlawful purposes;
• interfere with or attempt to compromise the operation or security of BTD;
• attempt to gain unauthorised access to accounts, systems or data;
• abuse authentication or alert systems;
• scrape or systematically extract BTD data in a manner that interferes with the service;
• introduce malicious code or other harmful material; or
• use BTD in a manner that materially harms the service or other users.

11. Intellectual Property

BTD's original software, design, branding, text, databases, compilation, graphics and other original content are protected by applicable intellectual property laws. Except as permitted by law, you must not copy, reproduce, republish, distribute, modify or commercially exploit BTD's original content or software without permission. Product names, trademarks, images and other third-party materials remain the property of their respective owners.

12. Service Availability

BTD is provided over the internet and may occasionally be unavailable due to maintenance, outages, upgrades, infrastructure failures or circumstances outside our reasonable control. We do not guarantee uninterrupted or error-free operation, and may modify, suspend or discontinue features where reasonably necessary.

13. No Warranty on Deal Outcomes

To the maximum extent permitted by law, BTD does not guarantee that:

• a particular deal will remain available;
• a displayed price will remain unchanged;
• a retailer will have stock;
• a retailer will accept or fulfil an order;
• an alert will be delivered without delay or error;
• a product will meet your requirements;
• a particular saving will be achieved; or
• using BTD will result in a financial benefit.

This section does not exclude or limit rights that cannot lawfully be excluded or limited.

14. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified. Where applicable consumer law applies to your use of BTD, those rights continue to apply.

15. Limitation of Liability

Subject to applicable law and any rights that cannot lawfully be excluded or limited, BTD will not be responsible for indirect, incidental, special or consequential loss arising from use of the service. Nothing in these Terms excludes liability where doing so would be unlawful.

16. Account Suspension or Termination

We may suspend or terminate access to an account where reasonably necessary to protect BTD, other users, our systems, or where an account is used in breach of these Terms. You may stop using BTD at any time. Account deletion is available through the service as described in the Privacy Policy. Termination or deletion does not affect provisions that by their nature should continue to apply.

17. Changes to BTD

We may change, add or remove features of BTD, and may update these Terms when the service, our practices or applicable legal requirements change. The updated Terms will carry a revised date.

18. Governing Law

These Terms are governed by the laws of the jurisdiction in which BigToolDeals operates, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute arising from them.

19. General

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of it. These Terms, together with any additional terms expressly incorporated into the service, govern your use of BTD.
